Electronic bundles (the "Bundles") and electronic books (the "eBooks") are created and owned by HEP, LLC doing business as "Pop-Doc" (the "Company"). Each Bundle and eBook is made available to you ("You") via the Company's website (the "Website"). THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND THE COMPANY. This Agreement governs the Company's return and refund policy (the "Policy") relating to your access to and use of the Bundles and/or eBooks.
Upon your purchase of a Bundle or an eBook and your assent to the Company's Terms of Service, Privacy Policy, and Electronic Bundle and eBook Disclaimer, the Company will not permit You to return or offer any refunds for the Bundle or eBook.
Notwithstanding the foregoing, if technical problems prevent or unreasonably delay delivery or use of the Bundle or eBook, your exclusive and sole remedy is either replacement or refund of the price paid, as determined at the sole and absolute discretion of the Company. If you discover what you believe is a defect in the Bundle or eBook which reasonably inhibits its use, please contact the Company at info@pop-doc.com. Such a defect, if any, may entitle You to an exchange or refund of the Bundle or eBook which is to be determined at the sole and absolute discretion of the Company.
Any refund will be credited back to the same payment method that You used to make your original purchase of the Bundle or eBook.
This Policy and any claim, controversy, dispute or cause of action based upon, arising out of or relating to your purchase of and your right to access and use a Bundle or eBook shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of laws or statutes.Any action or proceeding brought by either You or the Company arising out of this Policy or relating to the Bundles and/or eBooks shall be brought exclusively in the United States District Court for the Southern District of New York located in New York, New York or the Supreme Court of the State of New York, County of New York.
